Terms of Use

These terms are an agreement between you and Dras Labs LLC (“Dras Labs,” “we,” “us”) for using the Focal Keys keyboard, its companion app and focalkeys.com (together, the “Services”). By using the Services, you agree to them and to our Privacy Policy. If you don't agree, please don't use the Services.

1. Eligibility

You must be at least 18 and able to form a binding contract. You can't use the Services if you're barred from receiving them under US law, including if you're in a country under a US embargo or on a US government list of restricted parties.

2. What Focal Keys does

Focal Keys uses AI to suggest replies, polish your drafts and write openers. Suggestions are generated automatically and are only suggestions. AI can be wrong, awkward or unsuitable, so read every suggestion before you use it. Nothing is sent to anyone until you send it yourself.

3. Your responsibilities

4. What you can't do

We may suspend or end access for anyone who breaks these rules.

5. Your content

You keep ownership of what you submit and of the suggestions you choose to use. You give us permission to process your content only to provide the Services, as described in the Privacy Policy.

6. Our property and license

The Focal and Focal Keys names, logos, design and software belong to Dras Labs. We give you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, as these terms and the App Store's usage rules allow. These terms don't give you any other rights to our property.

7. Other apps

Focal Keys works inside other companies' apps, but it isn't affiliated with, endorsed by or sponsored by any dating or messaging app. Their names belong to their owners, and their own terms apply when you use them.

8. Beta versions

Beta versions are unfinished. They may have bugs, change without notice or stop working, and the separate Beta Tester Agreement in the app also applies while you test.

9. Feedback

We'd love your ideas. If you send feedback or suggestions, we can use them to improve Focal Keys without owing you anything for them.

10. Subscriptions (if we offer them)

Paid plans are sold through Apple and follow Apple's payment, renewal and refund rules. You can cancel anytime in your iPhone's subscription settings.

11. No guarantees

The Services are provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties of any kind, and we don't promise any particular outcome in your conversations or dating life.

12. Limits on liability

To the fullest extent the law allows, Dras Labs isn't liable for indirect, incidental, special or consequential damages, or for anything that happens between you and other people. Our total liability is limited to the greater of what you paid us in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not all apply to you.

13. Indemnity

To the extent the law allows, if a claim is brought against us because of something you sent or a rule you broke, you agree to cover the reasonable costs that result.

14. Changes and ending

We may update the Services or these terms. We'll post changes here with a new date, and if a change is meaningful, we'll tell you in the app before it applies. You can stop using Focal Keys anytime; we may end the Services with reasonable notice.

15. Law and disputes

These terms are governed by the laws of New Jersey, USA, without regard to conflict-of-law rules. Before filing a claim, please email us so we can try to resolve it. Disputes will be handled in the state or federal courts located in New Jersey, unless the law where you live gives you a different right.

16. Apple

If you got Focal Keys from the App Store, Apple's Licensed Application End User License Agreement also applies. These terms are between you and Dras Labs only, not Apple. Dras Labs, not Apple, is responsible for the app, its content, maintenance and support, and for handling any claims about it, including product, legal-compliance, consumer-protection, privacy and intellectual-property claims. If the app fails to meet a warranty that applies, you can notify Apple, and Apple may refund what you paid for it; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

17. General

These terms and the Privacy Policy are the whole agreement between you and us about the Services. If any part is found unenforceable, the rest still applies. If we don't enforce a term right away, we haven't given up the right to do so later.
